The firm represented Turner Construction, an international construction firm, in a dispute with a surety concerning the default of a subcontractor. The defaulted subcontractor’s scope of work was to construct a specialized air package handling unit in relation to Turner’s building of a Package Transport building at George H.W. Bush Intercontinental Airport in Houston, Texas.
Although the subcontractor had abandoned the work, the surety denied the claim of the contractor based on the contractor’s alleged failure to terminate the subcontractor. On the morning of trial, the firm obtained evidentiary rulings which led the court to enter judgment. The case was affirmed by the Texas Court of Appeals.
