The firm successfully represented a major insurer in connection with litigation brought by American Electric Power Company (“AEP”), upon a subsidiary’s policy that included employee theft coverage.  AEP claimed that it had discovered losses well in excess of the $20 million limits of the insurer's policy in connection with the alleged wrongful actions of two individuals who were associated with a limited liability company involving an AEP subsidiary, and it sued the insurer for coverage under the policy.  After complex and extensive discovery, the firm effected the filing of summary judgment pleadings on behalf of the insurer based upon the absence of coverage for the claimed losses.  Ultimately, AEP  recovered nothing on its claims.  The case was resolved by the district court’s issuance of summary judgment in the insurer's favor and the United States Fifth Circuit Court of Appeals’ affirmation of that decision.
